These Client Service Agreement & Rental Terms apply to all event styling, balloon décor, backdrop décor, marquee number setups, rental items, delivery, pickup, installation, and related services provided by Melody Decor Houston (“Melody Decor,” “we,” “us,” or “our”).
By submitting a request, paying a deposit, approving a quote, accepting delivery, picking up items, or allowing Melody Decor to install décor at an event location, the client, host, event organizer, or authorized representative (“Client,” “you,” or “your”) agrees to these Terms.
1. Services
Melody Decor Houston provides custom balloon décor, event styling, backdrops, marquee numbers, garlands, themed décor, and related event design services in the Houston area.
All designs are custom to the event date, venue, color palette, inspiration photos, inventory availability, budget, timing, and setup conditions.
A quote is not final until the event details, scope of work, timing, location, and payment/deposit are confirmed by Melody Decor.
2. Quotes, Design Changes, and Final Approval
Quotes are based on the information provided by the Client. Changes to venue, date, timing, design size, color palette, theme, access, floor plan, outdoor conditions, or delivery/pickup requirements may change the final price.
Final colors, layout, rental items, and design direction must be confirmed before the event. Melody Decor may make reasonable substitutions when exact colors, materials, flowers, props, balloons, or décor items are unavailable, as long as the final design remains close to the approved style and value.
Final colors, layout, rental items, custom text, vinyl, printed items, and design direction should be confirmed at least 7 calendar days before the event.
Last-minute changes may not be possible and may require additional fees.
3. Booking Deposit and Payment
A booking deposit may be required to reserve the event date. The booking deposit covers planning, preparation, inventory hold, labor scheduling, material sourcing, and administrative time for the confirmed event. The booking deposit is applied toward the final event total unless otherwise stated in the invoice or quote.
Final Payment Before Setup
The remaining balance must be paid in full before Melody Decor Houston begins installation, setup, styling, or placement of any décor or rental items at the event location.
By the time Melody Decor arrives at the event location, the Client understands that Melody Decor has already reserved the date, prepared the design, transported inventory, brought materials, and allocated labor and travel time for the event. For this reason, final payment is required before setup begins.
If the remaining balance is not paid before setup begins, Melody Decor may delay, pause, reduce, or decline installation until payment is received. Melody Decor is not responsible for any event delay, incomplete setup, reduced setup time, or cancellation caused by the Client’s failure to make the required payment on time.
If Melody Decor begins or completes installation before receiving the final balance as a courtesy or accommodation, the Client remains fully responsible for paying the outstanding balance immediately and before the event begins.
If the Client fails or refuses to pay the remaining balance after Melody Decor has arrived, begun setup, or completed setup, Melody Decor may stop work and may remove, retrieve, or take back any rental items, décor pieces, balloons, backdrops, stands, frames, marquee numbers, props, florals, materials, or reusable inventory provided by Melody Decor, where safe and legally permitted.
Removal or non-installation of décor due to non-payment does not waive the Client’s payment responsibility. The Client remains responsible for all amounts owed, including booking deposit, custom materials, printed items, special-order items, preparation costs, delivery, labor, travel, setup time, and any other agreed charges or losses caused by non-payment.
Melody Decor may use any lawful remedies available to collect unpaid balances, including sending invoices, payment reminders, collection efforts, or filing a claim in the appropriate court if necessary.
4. Rental Items Remain Property of Melody Decor
All rental items remain the property of Melody Decor Houston unless the invoice clearly states that an item is being sold to the Client.
Rental items may include, but are not limited to:
- Backdrops
- Arches
- Stands
- Frames
- Marquee numbers or letters
- Floral pieces
- Props
- Bases and weights
- Covers and fabrics
- Sign holders
- LED or decorative elements
- Any reusable décor item provided by Melody Decor
The Client may not sell, rent, move, alter, repaint, cut, tape, staple, drill, glue, climb on, sit on, lean on, hang items from, or otherwise modify rental items without written permission from Melody Decor.
5. Delivery, Setup, and Venue Access
The Client is responsible for providing correct event details, including full address, venue name, room name, parking/loading instructions, elevator access, gate codes, contact person, setup time, pickup time, and venue rules.
The Client is responsible for making sure the venue allows the requested décor and that all necessary permissions are obtained before Melody Decor arrives.
The Client must provide safe, clear, and timely access for delivery, setup, and pickup. Delays caused by unavailable access, incorrect address, locked rooms, unavailable elevators, parking issues, security restrictions, or venue restrictions may result in additional fees or reduced setup time.
Melody Decor is not responsible for venue restrictions, venue refusal, lack of access, unsafe setup areas, or changes required by the venue on the day of the event.
6. Pickup, Client Pickup, and Return of Rental Items
If the Client picks up any décor or rental item, the Client accepts full responsibility for the item from the moment it is handed over until it is returned and inspected by Melody Decor.
If Melody Decor delivers or installs décor, the Client accepts responsibility for supervising, protecting, and preserving the décor and rental items after installation is completed or after Melody Decor leaves the event location.
Rental items must be available for pickup at the agreed time and location. Items must not be removed, relocated, hidden, locked away, taken by guests, thrown away, damaged, or transferred to another location without written permission from Melody Decor.
If Melody Decor cannot retrieve rental items at the agreed pickup time due to locked access, missing contact person, venue closure, parking restriction, room change, or any other issue outside our control, additional pickup, late, or replacement fees may apply.
If Melody Decor’s rental items, inventory, or team members are prevented from safely leaving, retrieving rental property, or completing pickup, or if there is threatening, unsafe, or unlawful conduct at the event location, Melody Decor may contact venue security, property management, or law enforcement as appropriate.
7. Security Deposit, Damage, Missing Items, and Late Returns
Melody Decor may require a refundable security deposit for rental items. This security deposit is separate from the booking deposit unless the invoice states otherwise.
The booking deposit reserves the event date and may become non-refundable under the cancellation, rescheduling, payment, or custom-material terms in this Agreement.
The security deposit is used only for rental item damage, missing items, late return, extra pickup, cleaning, replacement, or related rental-property costs.
The security deposit may be withheld fully or partially if rental items are:
- Damaged
- Broken
- Missing
- Stained
- Torn
- Bent
- Scratched
- Modified
- Returned late
- Returned dirty beyond normal use
- Exposed to rain, water, mud, smoke, fire, food, drinks, paint, glitter, confetti, pets, or misuse
- Not available for pickup at the agreed time
- Not returned in the same condition as received
If the cost of repair, cleaning, late pickup, replacement, or lost inventory is higher than the security deposit, the Client is responsible for the remaining balance.
Normal wear from reasonable use is expected. Damage, misuse, loss, theft, late return, or failure to protect rental items is not considered normal wear.
8. Safety Around Décor and Rental Items
Balloon décor, backdrops, arches, stands, frames, marquee numbers, props, flowers, and lightweight decorative structures are for visual and decorative purposes only.
They are not toys, climbing structures, seating, support structures, barriers, or play equipment.
The Client is responsible for keeping children, guests, pets, vendors, and attendees from pulling, climbing, leaning, hanging, moving, kicking, stepping on, eating, or misusing any décor or rental item.
The Client is responsible for maintaining a safe area around all décor, including walkways, entrances, exits, dance floors, photo areas, tables, stairs, and high-traffic areas.
Melody Decor is not responsible for injuries, accidents, trips, falls, allergic reactions, choking, property damage, or other incidents caused by guest behavior, lack of supervision, venue conditions, misuse, relocation, tampering, weather, or the Client’s failure to maintain a safe event environment after delivery, pickup, handoff, or installation.
9. Important Safety and Liability Release
IMPORTANT: PLEASE READ CAREFULLY.
TO THE MAXIMUM EXTENT ALLOWED BY LAW, CLIENT UNDERSTANDS AND AGREES THAT EVENT DÉCOR, BALLOONS, BACKDROPS, FRAMES, STANDS, MARQUEE NUMBERS, PROPS, WEIGHTS, BASES, FLORAL PIECES, AND RELATED RENTAL ITEMS MAY CREATE RISKS IF THEY ARE MOVED, MISUSED, PULLED, CLIMBED ON, TRIPPED OVER, PLACED IN UNSAFE AREAS, EXPOSED TO WEATHER, OR LEFT UNSUPERVISED.
CLIENT ACCEPTS RESPONSIBILITY FOR SAFE USE, SUPERVISION, PROTECTION, AND CONTROL OF ALL DÉCOR AND RENTAL ITEMS AFTER DELIVERY, PICKUP, HANDOFF, INSTALLATION, OR ONCE MELODY DECOR LEAVES THE EVENT LOCATION.
TO THE MAXIMUM EXTENT ALLOWED BY LAW, CLIENT RELEASES, WAIVES, AND HOLDS HARMLESS MELODY DECOR HOUSTON, ITS OWNERS, WORKERS, CONTRACTORS, HELPERS, AND REPRESENTATIVES FROM CLAIMS, DAMAGES, LOSSES, COSTS, INJURIES, ACCIDENTS, TRIPS, FALLS, PROPERTY DAMAGE, OR OTHER CLAIMS ARISING FROM OR RELATED TO THE CLIENT’S EVENT, GUESTS, VENUE CONDITIONS, USE OR MISUSE OF DÉCOR, RENTAL ITEMS, BALLOONS, BACKDROPS, STANDS, FRAMES, MARQUEE NUMBERS, PROPS, DELIVERY, PICKUP, INSTALLATION, OR EVENT CONDITIONS, INCLUDING CLAIMS ALLEGED TO ARISE FROM MELODY DECOR HOUSTON’S ORDINARY NEGLIGENCE, EXCEPT TO THE EXTENT SUCH CLAIMS ARE CAUSED BY MELODY DECOR HOUSTON’S GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR CONDUCT THAT CANNOT BE RELEASED UNDER APPLICABLE LAW.
10. Client Indemnification
To the maximum extent allowed by law, the Client agrees to defend, indemnify, and hold harmless Melody Decor Houston, its owners, workers, contractors, helpers, and representatives from claims, damages, losses, costs, fees, injuries, property damage, or expenses arising from:
- Guest misuse of décor or rental items
- Children or pets interacting with décor
- Client or venue moving or modifying the setup
- Unsafe event conditions
- Venue restrictions or violations
- Damage, theft, or loss of rental items
- Failure to return rental items
- Failure to supervise the décor area
- Failure to follow safety instructions
- Outdoor weather exposure
- Any claim by guests, attendees, vendors, venue staff, or third parties related to the event setup after delivery, pickup, handoff, or installation
11. Outdoor Events, Weather, Heat, Wind, and Sun
Outdoor balloon décor and lightweight décor are affected by weather and environmental conditions, including heat, direct sunlight, wind, rain, humidity, uneven ground, grass, sprinklers, mud, dust, insects, and venue layout.
Melody Decor cannot guarantee the same durability, appearance, or lifespan for outdoor décor as indoor décor.
The Client accepts all risks related to outdoor setups, including balloon popping, fading, shifting, movement, deflation, frame movement, or décor damage caused by weather, heat, wind, rain, sun, guests, pets, or venue conditions.
For outdoor events, the Client is responsible for providing a safe indoor or covered backup location if weather, heat, wind, rain, direct sun, or venue conditions make the setup unsafe or unsuitable.
Melody Decor may modify, reduce, relocate, or decline outdoor installation if conditions appear unsafe, unstable, or unsuitable for the requested design.
12. Venue Rules and Restrictions
The Client is responsible for confirming all venue rules before booking, including rules about balloons, helium, confetti, tape, command hooks, nails, backdrops, marquee numbers, flames, candles, electricity, delivery access, pickup access, insurance requirements, and teardown time.
Melody Decor is not responsible if a venue refuses the décor, changes the allowed setup area, requires a smaller design, restricts access, or demands early removal.
Any additional cost caused by venue rules, limited access, early pickup, late pickup, parking, loading dock requirements, stairs, elevator restrictions, or security restrictions is the Client’s responsibility.
13. Prohibited Use
The Client may not:
- Move installed décor without permission
- Allow guests to climb, sit, pull, or hang on décor
- Use open flames near balloons, fabric, florals, props, or backdrops
- Attach items to Melody Decor rental pieces without approval
- Use tape, staples, glue, nails, screws, paint, or adhesives on rental items
- Leave rental items outdoors overnight unless approved
- Throw away rental items
- Give rental items to guests or vendors
- Use rental items for another event or location
- Allow children to play with frames, stands, bases, balloons, or marquee numbers
14. Allergies, Choking Hazards, and Children
Balloons and small decorative pieces may present choking hazards, especially for young children and pets. Some décor materials may include latex, vinyl, plastic, metal, wood, fabric, faux flowers, lights, adhesives, or other materials.
The Client is responsible for supervising children, pets, and guests around all décor.
Clients should notify Melody Decor in writing before the event if latex-free, allergy-sensitive, or special material considerations are required. Melody Decor cannot guarantee an allergen-free environment unless specifically agreed in writing.
15. Photos, Inspiration Images, and Design Use
Clients may upload inspiration photos to help Melody Decor understand the desired style, color palette, or theme. By uploading or sending photos, the Client confirms that the Client has the right to share those photos for design planning purposes.
Melody Decor may photograph completed setups for portfolio, website, social media, marketing, and business use unless the Client requests privacy in writing before the event. Melody Decor will make reasonable efforts not to feature private guests or children prominently without permission.
16. Intellectual Property and Custom Designs
Melody Decor’s design concepts, styling direction, layouts, written proposals, mockups, photos, and custom design recommendations remain the intellectual property of Melody Decor unless otherwise agreed in writing.
The Client may use the décor for the confirmed event only. The Client may not copy, sell, reproduce, or use Melody Decor’s design materials for another vendor, event, or commercial purpose without permission.
17. Cancellation, Rescheduling, and Force Majeure
If the Client needs to cancel or reschedule the event, the Client must notify Melody Decor Houston in writing as soon as possible.
Cancellations must be submitted in writing at least 7 calendar days before the scheduled event date. Written notice may be sent by text message, email, WhatsApp, invoice message, or another written method accepted by Melody Decor.
If the Client cancels 7 or more calendar days before the event date, the booking deposit may be refunded or applied toward a future event, at Melody Decor’s discretion, after deducting any non-refundable costs already incurred, including custom materials, printed items, personalized vinyl, special-order balloons, outsourced items, design preparation, and production costs.
If the Client cancels less than 7 calendar days before the event date, the booking deposit is non-refundable. Any custom materials, printed items, personalized items, special-order items, outsourced items, and preparation costs are also non-refundable once ordered or prepared.
Rescheduling is subject to Melody Decor’s availability. A rescheduling fee or additional payment may be required if the new date, location, timing, design, materials, or setup requirements change.
If the Client cancels on the event day, fails to provide access to the venue, provides an incorrect address, or the venue refuses the setup due to rules or restrictions not disclosed in advance, the booking deposit and any preparation, delivery, custom, or labor-related fees may be non-refundable.
If an event is affected by severe weather, emergency, illness, accident, venue closure, power outage, road closure, natural disaster, government restriction, or any condition outside the reasonable control of Melody Decor, Melody Decor may modify, delay, reschedule, or cancel the service. In such cases, Melody Decor’s liability is limited to amounts paid for services not provided, unless otherwise required by law.
18. Limitation of Liability
To the maximum extent allowed by law, Melody Decor Houston’s total liability for any claim related to services, décor, rental items, delivery, pickup, installation, delay, cancellation, or event conditions is limited to the amount paid by the Client to Melody Decor for the specific event giving rise to the claim.
Melody Decor is not responsible for indirect, incidental, special, emotional, reputational, lost profit, lost opportunity, or consequential damages.
19. Communication
Client communication may occur by phone, text message, WhatsApp, email, website form, invoice notes, or other written method.
The Client is responsible for providing accurate contact information and responding promptly to time-sensitive event questions.
20. Privacy
Melody Decor may collect the Client’s name, phone number, email, event date, event location, event type, budget, inspiration photos, and event notes for quote preparation, communication, booking, delivery, and service purposes.
Melody Decor does not sell Client information. Client information may be used only for business communication, event planning, service delivery, payment coordination, and related administrative purposes.
21. Governing Law
These Terms are governed by the laws of the State of Texas. Any dispute related to these Terms or services provided by Melody Decor Houston shall be handled in Texas unless otherwise required by law.
22. Agreement
By checking the agreement box, submitting a request, paying a deposit, approving a quote, accepting delivery, picking up items, or allowing installation, the Client confirms that the Client has read, understands, and agrees to these Client Service Agreement & Rental Terms.
